Welcome to ALERTZ, a global safety and security platform that empowers users to share and receive real-time incident alerts. These Terms of Service (“Terms”) govern your use of the ALERTZ mobile app, website, services, and any associated features (collectively, the “Service”).
By accessing or using ALERTZ, you agree to be legally bound by these Terms, including our Privacy Policy, which explains how we collect, use, and protect your personal data.
If you do not agree to these Terms, please do not use the Service.
You must be at least 13 years old to use ALERTZ. If you are under 18, you may use the Service only with involvement of a parent or guardian.
To access core features, you must register an account. Registration is pseudonymous; you may select a display name and are not required to provide personally identifiable information such as email address or phone number.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate information during registration and to update it if necessary.
ALERTZ is a platform for user-generated content including but not limited to incident reports, comments, reactions, and live streams (“User Content”).
When you submit User Content, you represent that you have all necessary rights to grant ALERTZ the licenses described below and that your content complies with these Terms.
By submitting User Content, you hereby grant ALERTZ a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, and otherwise exploit the User Content in connection with the Service and ALERTZ’s business.
You expressly assign ownership of incident reports (including text, images, video, and other media) submitted through ALERTZ to ALERTZ. This assignment is irrevocable and effective upon submission.
Your personal identifying information linked to User Content is stored separately from the content itself. Upon your request, ALERTZ will delete your personal data, but will retain the incident report User Content as its property.
You waive any moral rights to the User Content submitted to ALERTZ to the fullest extent permitted by law.
Your use of the Service is subject to ALERTZ’s Privacy Policy, which details how we collect, use, and protect your personal data.
ALERTZ is committed to protecting your privacy and complies with applicable data protection laws including CCPA and GDPR where applicable.
You have the right to access, export, correct, or delete your personal data as described in the Privacy Policy. Please note, the deletion of your personal data does not include deletion of User Content that ALERTZ owns under Section 3.2.
ALERTZ reserves the right to remove any User Content that violates these Terms and to suspend or terminate accounts engaging in prohibited conduct.
ALERTZ employs automated tools and human moderators to review User Content for compliance with these Terms.
We may remove or restrict access to User Content at our sole discretion, including but not limited to content flagged by users or detected by moderation systems.
We are not responsible for User Content and do not guarantee its accuracy or completeness. You acknowledge that ALERTZ is a platform and does not endorse or verify the truthfulness of User Content.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
ALERTZ does not guarantee the accuracy, completeness, or reliability of User Content or third-party data.
You use the Service at your own risk. ALERTZ is not responsible for any harm or loss resulting from your reliance on the Service. To the maximum extent permitted by law, ALERTZ and its affiliates, officers, employees, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
You agree to indemnify, defend, and hold harmless ALERTZ and its affiliates from any claims, damages, liabilities, costs, or expenses arising out of your violation of these Terms or your User Content.
ALERTZ may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason without prior notice.
Upon termination, your rights to use the Service cease immediately, but ALERTZ’s license to your User Content continues as described in Section 3.2.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service will be resolved through binding arbitration in Delaware unless otherwise required by law.
ALERTZ reserves the right to update or modify these Terms at any time.
When material changes occur, ALERTZ will notify users by sending an in-app notification to their account username and by publishing the updated Terms on the ALERTZ official website.
It is your responsibility to review these Terms periodically. Continued use of the Service after changes constitutes acceptance of the new Terms.
